As the European Union moves forward with implementing the AI Act, companies developing and deploying general-purpose AI models need to be fully aware of the new compliance landscape. The legislation introduces rigorous standards aimed at ensuring AI technologies are safe, transparent, and adhere to intellectual property laws.

Article 53 explained

Article 53 of the AI Act, found in Section 2 under "Obligations for providers of general-purpose AI models," outlines specific responsibilities for AI providers. These include:

1. Documentation and transparency

Providers must create and maintain detailed technical documentation of their AI models. This includes information on the training and testing processes and the results of evaluations, adhering to the minimum requirements set out in Annex XI. Such documentation must be available to the AI Office and national competent authorities upon request.

2. Support for AI System integrators

Providers must also supply updated information and documentation to other providers who intend to integrate these general-purpose AI models into their systems. This documentation must help integrators understand the models' capabilities and limitations and ensure they meet their regulatory obligations, as detailed in Annex XII.

3. Copyright compliance

It is mandatory to implement policies that comply with Union copyright law. This involves using advanced technologies for copyright identification and protection, particularly focusing on the reservation of rights as outlined in Article 4(3) of Directive (EU) 2019/790.

4. Public disclosure

Providers are required to produce and publicly share detailed summaries about the content used for training their AI models, based on a template from the AI Office.

Penalties for non-compliance

Failing to adhere to Article 53 can lead to substantial penalties. Infringements could see fines up to €40 million or 7% of worldwide annual turnover for prohibited AI practices, with additional fines for violations related to data governance and transparency requirements.
